Texas Mugshot Correction Rules

Texas Business & Commerce Code chapter 109 regulates covered businesses that publish criminal-record information. The law is not a broad ban on government booking photos.

Expunction and nondisclosure are different. An expunction order can direct covered agencies to destroy or return records and may permit denial of the arrest in circumstances set by law. Nondisclosure restricts public release of covered criminal-history data but does not erase every record or bar every authorized government use. Eligibility is fact-specific. Do not republish an old mirror just to defeat a lawful change.

Burleson and State Photo Differences

Government Code §552.029 lists a TDCJ department photograph among public state-prison information despite the corrections-record exception in §552.134. Yet TDCJ’s basic email information service expressly does not provide photographs. A formal TDCJ public-information route may be needed, and the resulting department image documents state custody rather than the county booking.

The Texas DPS Sex Offender Registry has photographs only for people who have a registration duty. It is not a general list of released people and does not itself establish a release date.

Burleson Booking Photo Policy Gap

No official Burleson booking-photo retention or web-display policy surfaced in the reviewed sources. The county request form is therefore the local first-party path. A portrait can remain visible after bond, dismissal, sentence completion, or transfer.
